Property Transfer


Transferring Title of a property without selling it is a simple and very common process. There are several reasons why a property owner may transfer ownership of a property. 

Some reasons include:

  • Adding a person to the title of a property

  • Transferring property between family members, such as parents selling, transferring or gifting the property to their children

  • If the property is jointly owned and one of the owners pass away

  • If the property was left to a beneficiary of an Estate

  • If the property is held by proprietors (owners), and one of the proprietors wants to buy the other owner out or vice versa

  • Marriage or relationship breakdown may see one party transfer the property to the other party as part of the separation/ settlement

  • Ownership of the property might be transferred to a company for taxation purposes

Although transferring Title of a property is a different process from buying or selling as a Contract for Sale is not required, it is still prudent to engage a property law expert.
