One of the biggest issues during a property settlement is figuring out how to divide your assets after a breakdown of relationship.

Usually after separation, it is assumed that assets are shared. Assets including property, bank accounts, superannuation, shares, businesses, vehicles etc will all be taken into consideration as well as any liabilities and debts each party may hold. 

However, the way assets and liabilities are shared will depend on several factors. 

If you have an amicable relationship with your partner after separating, the two of you can agree on how to divide your assets and liabilities between you. This can be done by obtaining legal advice by way of Binding Financial Agreement or Consent Orders.
